So as to leave no doubt in respect in the outcome of the dispute between KBDB and BRICON NV regarding the homologation and the use of the Hitag-S chip rings of BRICON, KBDB and BRICON NV wish to announce the following :

By decision of 18 October 2006, the President of the Brussels’ Court of Commerce has condemned KBDB because of the non-homologation of the Hitag-S chip rings of BRICON NV.

As a consequence of this judgement KBDB explicitly recognises the final homologation of the Hitag-S chip rings of BRICON NV and confirms that the validity of all resultants obtained by pigeons using these chip rings cannot be contested. The Hitag-S chip rings of BRICON NV fulfil all requirements and must therefore be admitted in all pigeon races.

BRICON NV hereby announces that it renounces to claim any damages from KBDB in order to avoid that its clients/friends pigeon fanciers would indirectly have to carry the burden of the damages claim through an increase of the membership fees. (3.11.06)
